These Terms of Service ("Terms") govern your use of fosterhealth.io (the "Site"), operated by Foster Health Technologies, Inc. ("Foster," "we," "us"). By using the Site, you agree to these Terms. If you do not agree, please do not use the Site.
These Terms cover the Site only. Foster's services to customers, including MDS coordination, coding support, and related offerings, are provided under separate written agreements, including master service agreements, pilot agreements, and business associate agreements where applicable. If there is a conflict between these Terms and a signed customer agreement, the customer agreement controls for the services.
Informational purposes only
Content on this Site is for general information about Foster and its offerings. It is not clinical, legal, billing, coding, or reimbursement advice, and it is not a substitute for the judgment of licensed professionals or for your organization's own compliance obligations. Descriptions of outcomes reflect the design and intent of our services; results vary by facility.
Use of the Site
You agree to use the Site lawfully and not to: interfere with its operation or security; attempt to gain unauthorized access to any systems or data; scrape, harvest, or systematically extract content or data; misrepresent your identity or affiliation; or submit protected health information or other sensitive personal information through the Site.
Intellectual property
The Site and its content, including text, design, graphics, logos, and software, are owned by Foster or its licensors and protected by intellectual property laws. We grant you a limited, revocable, non-exclusive license to view the Site for your internal business evaluation. You may not republish, sell, or reproduce Site content without our prior written permission. "Foster" and associated marks may not be used without permission.
Submissions
If you submit information through the Site, such as through our contact form, you represent that you have the right to share it and that it does not include PHI or confidential information of third parties. Our handling of personal information is described in our Privacy Policy.
Third-party links
The Site may link to third-party websites. We are not responsible for their content or practices, and a link does not imply endorsement.
Disclaimer of warranties
The Site is provided "as is" and "as available." To the maximum extent permitted by law, Foster disclaims all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or secure.
Limitation of liability
To the maximum extent permitted by law, Foster will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising from or related to your use of the Site. To the maximum extent permitted by law, Foster's total liability arising from or related to the Site will not exceed one hundred U.S. dollars ($100). Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.
Indemnification
You agree to indemnify and hold Foster harmless from claims, losses, and expenses (including reasonable attorneys' fees) arising from your misuse of the Site or violation of these Terms.
Governing law
These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles. Any dispute arising from these Terms or the Site will be brought exclusively in the state or federal courts located in San Francisco County, California, and you consent to their jurisdiction.
Changes
We may update these Terms from time to time. The revised Terms will be posted here with an updated date, and your continued use of the Site after changes take effect constitutes acceptance.
